Buyer's acceptance of offer is conditional upon Seller's acceptance of Buyer's applicable terms and conditions. The following terms and conditions may apply to your offer:

For the purchase of goods: Attachment 31

For the purchase of services: Attachment 8a or Attachment 8b. Contact Buyer for clarification regarding which attachment will apply to your offer.

For the purchase of construction or professional services (e.g., architects, engineers): Refer to the posting or contact Buyer.

All purchases using federal funds:*

Awards may be made by item, groups of items, or the total aggregate amount for all items included in the offer, whichever is stated as the Basis for Award. Buyer reserves the right to reject any and all offers, and waive any defect(s) or authorize any substitution(s), when in its opinion, such rejection, waiver or substitution will be in the best interest of Buyer.
Brand names, when used, indicate standards of quality and performance desired. If a brand name is specified, followed by the words "or acceptable alternate", any brand equal in quality and performance may be proposed if Seller specifies the brand and model no., and provides descriptive brochures and specifications. If only one brand is specified, alternative brands will not be accepted, and Seller must offer the specified brand. Seller agrees that the finding of each Buyer shall be final and binding.
